This Privacy Policy explains how Walk In Corp (“WalkIn IQ”, “we” or “us”) collects, uses, discloses, and processes personal information about individuals, including when you use (i) our websites or other online products (collectively, our “Platform”), our mobile applications, such as the ConnectIQ app or the SelfTourIQ app (collectively, our “Apps”), and other related services, such as contacting us for customer support (collectively, our Platform, Apps, and all such related services, our “Services”), or (ii) when you otherwise interact with us, such as via social media or in applying for a job with Walk In.

Please note that this Privacy Policy only applies to Walk In. When you use third party products and services that are designed for use with our Services, such as door hardware locks, personal information may be collected by such third parties (which is not controlled by Walk In). We recommend that you review the privacy practices of these third parties to understand how those third parties collect, use, and/or disclose your personal information, if applicable.

Further, if you are using Walk In’s Services on behalf of an organization (such as your employer) or if a property owner, property manager, or other user has provided you with access to Walk In’s Services (such as to enable you a property, unit, or other unique access point), then that organization or user may also collect personal information regarding your use of Walk In’s Services (which is also not controlled by Walk In). We also recommend that you review any such organization’s policies (if applicable) to understand how such organization collects, uses, and/or discloses your personal information.

Information We Collect

The information we collect may vary, depending on which of our Services you use.

We collect the information you provide directly to us, which may include:

  • Account Information: Information you provide to create an account such as name, email address, mobile phone number, and other biographical information.
  • Contact Information: Information such as name, job title, email address, physical address, phone number, or other contact information, such as you may provide when requesting a demonstration of our Services, applying for a job, or contacting customer support.
  • Feedback and Communications: Information you submit to us, such as customer feedback (whether in written, oral, or electronic form) or other information you provide when you interact with us, including communicating with us via email or social media.
  • Other Information with Your Permission: With your permission, Walk In may also collect additional information from you, including, without limitation, from features on your mobile device if you use one of Walk In’s Apps. For example, Walk In’s Apps may request your permission to access your mobile device’s camera, Bluetooth functionality, and/or information about your location. Please refer to “Your Choices” below for more information regarding your choices when it comes to this access.

We may also automatically collect information about you during your use of our Services, including:

  • Log Information: We log certain personal information about your access to and use of the Services. For Services provided via our Platform, such personal information may include which properties, units, or other unique access points you access and when you do so, the type and language of browser you use, the access times, pages viewed, links clicked, your IP address, your Internet Services provider (ISP), the pages you visited before and after navigating to the Platform.
  • Device Information: We also collect certain personal information about the device you use to download the Apps or other access the Services, including the operating system and version, hardware make and model, and mobile network information.
  • Information Collected by Cookies and Other Tracking Technologies: Like most online services and mobile applications, we may use cookies and other technologies, such as web beacons, web storage, and unique advertising identifiers, to collect information about your activity, browser, and device and some of this information may be personal information. Cookies are small data files stored on your hard drive or in device memory that help us to improve our Services, analyze which areas and features of our Services are popular, and understand other aspects of our Services, such as numbers of unique visitors. We may also collect information using web beacons (also known as “tracking pixels” or “clear GIFs”). Web beacons are electronic images that may be used in the Services or an email we may send, including to help deliver cookies, understand usage and campaign effectiveness, and determine whether an email has been opened and acted upon. Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of certain parts of our Services. For more information about cookies and how to disable them, please see “Your Choices” below.

We may also obtain personal information about you from other sources, including:

  • Our third-party service providers: We use certain service providers to verify the identify of users of our services and otherwise to prevent fraud and secure our Services. We may receive certain personal information about you from such service providers.
  • Our customers: If a customer of ours, such as a property owner or manager, creates an account for you to be able to access a property, unit, or other unique access point, we receive personal information about you from such customer.
  • Other users of our Services: If you are invited to use our Services by one of our visitors, such as if you are a visitor to one of our users, we receive personal information about you from such user.

How We Use Personal Information

We use the personal information we collect to enable the features and functionality of the Services you use and to provide, maintain, and improve such Services.

We also use personal information to:

  • Respond to your comments, questions, and requests, and provide customer service;
  • Send you technical notices, updates, security alerts, and support and administrative messages;
  • Send you SMS/text messages, such as to invite you to download one of our Apps from the applicable app store or to provide customer support and administrative communications, primarily in connection with a self-guided tour of a property (see “Text Messaging (SMS) Communications” under “Your Choices” below for more information);
  • Communicate with you about products, services, offers, promotions, rewards, and events we offer and provide news and information we think will be of interest to you;
  • Personalize and improve the Services and provide content or features that match user profiles or interests;
  • Monitor and analyze trends, usage, and activities in connection with the Services;
  • Develop new products and services; and
  • Carry out any other purpose as disclosed in this Privacy Policy or that was disclosed to you at the time we collected such personal information.

When We Disclose Personal Information

We may disclose personal information we collect or receive about you as follows:

Other users: There are a variety of ways in which you can choose to share information with other members of the Walk In community. For instance, certain of our Services include chat functionality that allow you to interact with other users.

Our third-party service providers: We may engage third parties to deliver a product or service on our behalf (or enhance specific features within our offerings), or to perform certain tasks, at our direction.

Our customers: When you use our Services as part of your employment with one of our customers or when you use our Services in connection with accessing a property, unit, or other unique access point owned or managed by one of our customers, they may make certain organization-level decisions which provide them with certain information about you and your usage of the Services (such as when you access such property, unit, or other unique access point). Please review such organization’s policies or contact the applicable organization directly to learn more about the information shared with such organization.

Third party solutions: Certain features of our Services use or incorporate third party solutions and, when you use such features, third parties may collect data from such use. For example, if you view an embedded video on our Services using YouTube’s video player, YouTube collects certain information regarding such use. Please see Google’s Privacy Policy for details on what personal information they collect via YouTube’s services and how they use this information.

Other: In addition to the above, we may also disclose personal information as follows:

  • In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law, regulation, public authority request or legal process, including to meet national security or law enforcement requirements.
  • If we believe your actions are inconsistent with our user agreements or policies to enforce or fulfill such agreements or policies.
  • To protect the rights, property and safety of Walk In or others.
  • In connection with, or during negotiations of, any merger, sale of assets, financing or acquisition of all or a portion of our business.
  • Between and among Walk In and our current and future parents, affiliates, subsidiaries and other companies under common control and ownership.
  • Otherwise with your consent or at your direction.

We may also share aggregated or de-identified information, which cannot reasonably be used to identify you, with others.

Your Choices

Account Information

You can delete your account at any time. You can also request that we update, correct or delete the personal information associated with your at any time by contacting us at support@walkinIQ.com. Note that we may retain certain personal information following request for deletion as required by law or for legitimate business purposes, to the extent permitted by law.

Mobile Device Permissions

If you have granted one of Walk In’s App’s permission to access information via your mobile device, the settings in your mobile device should allow you to stop sharing access to certain information or features with us via such App. For example, you should be able to deactivate our access to your camera, Bluetooth functionality and/or your location information using the settings on your mobile device. Please note that deactivating our access to certain personal information from your mobile device may limit the features and/or functionality available to you via our Services.

Text Messaging (SMS) Communications

If you provide us with your mobile phone number, WalkIn IQ may send you SMS/text messages to (i) invite you to download one of our Apps, such as the ConnectIQ app or the SelfTourIQ app, from the applicable app store, and (ii) provide you with customer support and administrative communications, primarily in connection with a self-guided tour of a property. By providing your mobile phone number and opting in, you consent to receive such SMS/text messages from us, or from a third-party service provider on our behalf, at the number provided. Message frequency varies, and message and data rates may apply. You may opt out of receiving SMS/text messages from us at any time by replying “STOP” to any message you receive, and you may reply “HELP” for assistance. After you text “STOP,” we may send you one final message confirming your opt-out, and you will no longer receive SMS/text messages from us unless you subsequently opt back in. We do not share your mobile phone number or SMS opt-in consent with third parties for their own marketing purposes. Carriers are not liable for delayed or undelivered messages.

Promotional Communications

You may opt-out of receiving promotional communications from us by following the instructions in those communications. If you opt-out, we may still send you non-promotional communications, such as those about your account or our ongoing business relations.

Other Important Details

Our Audience

Our Services are not directed to children under the age of 13. Users must be 18 years old to create an account as a primary user and at least 13 years or older to use an account as a visitor. Visitor accounts for users under the age of 18 must be created by a primary user with permission from such minor’s parent or guardian. If we have actual knowledge that a user is are under the age of 13 (or the minimum age at which a person may use the Services in your state, without the consent of a parent or guardian, if greater), we will stop providing Services to such user and delete the account and associated personal information. In addition, we may also limit how we collect, use, and store some of the personal information of users under 18. In some cases, this means we will be unable to provide certain functionality to people under the age of 18.

Changes to this Privacy Policy

Walk In may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this Privacy Policy and, in some cases, we may provide you with additional notice (such as adding a statement to our Platform or sending you an email notification). We encourage you to review this Privacy Policy periodically to stay informed about our personal information processing practices and the ways you can help protect your privacy.

Security

We take reasonable measures to help protect information about you from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction.

Data Retention

We process the personal information we collect about you for as long as is necessary for the purpose(s) for which we originally collected it. We may retain certain information for legitimate business purposes or as required by law. For example, we will process personal information you have provided in connection with an account you maintain with us for the duration of our applicable contract, and may retain certain information thereafter to meet record retention obligations. Where we process information based on your consent, we will retain such information until you revoke such consent.

Walk In is based in the United States and we process and store information primarily in the U.S.

Welcome to Walk In IQ. These Terms of Use (“Terms”) are a binding agreement between you and Walk In Corp. (“Walk In,” “we,” “us,” or “our”), a company headquartered at 524 North Ave, New Rochelle, NY 10801. These Terms govern your access to and use of Walk In’s websites and online products (collectively, our “Platform”), our mobile applications, including the AccessIQ app, SelfTourIQ app, and theGPConnect app (collectively, our “Apps”), and related services such as self-guided tours, keyless access control, turnover management, energy management, package room management, and customer support (collectively, together with the Platform and Apps, our “Services”).

By creating an account, downloading or using an App, accessing the Platform, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not access or use the Services.

If you are using the Services on behalf of an organization (such as your employer or a property owner or manager), you represent that you have authority to bind that organization to these Terms, and “you” refers to both you and that organization.

1. Eligibility and Account Registration

You must be at least 18 years old to create an account with Walk In as a primary user (for example, a property owner, property manager, or resident who administers a unit). Individuals between the ages of 13 and 18 may use the Services only as a visitor account created by a primary user, and only with the consent of that minor’s parent or guardian. The Services are not directed to, and we do not knowingly permit use by, children under 13. If we learn that a user is under the age of 13 (or the applicable minimum age in your state without parental consent), we will terminate that account and delete the associated personal information.

To use certain features of the Services, you must register for an account and provide accurate, current, and complete information, including your name, email address, and mobile phone number. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us promptly at support@walkiniq.com of any unauthorized use of your account or any other breach of security.

2. Description of the Services

Walk In IQ is a smart access control and property automation platform. Depending on the plan a property owner or manager (a “Customer”) has selected, the Services may include, among other things:

  • Self-guided property tours through the SelfTourIQ app, allowing prospective renters to schedule and complete tours independently;
  • Keyless entry and digital key issuance and management through the ConnectIQ app for residents, staff, and contractors;
  • Turnover and unit-lifecycle management tools for property staff;
  • Energy management features that monitor and help reduce energy usage at a property; and
  • Integrations with third-party property management systems, access control and lock hardware, and energy management systems.

Walk In IQ is offered on an a la carte, per-unit, per-month basis, billed annually, and Customers may select individual features rather than the full suite of Services. The specific features available to you will depend on how the Customer associated with your property or account has configured the Services.

3. Third-Party Products, Hardware, and Integrations

The Services are designed to work with, and in some cases rely on, third-party hardware and software, such as door locks and other access control hardware, property management systems, and energy management systems. Walk In does not manufacture this third-party hardware and is not responsible for its performance, availability, or security. Your use of any third-party product or service in connection with the Services is subject to that third party’s own terms and privacy practices, which we encourage you to review. Walk In disclaims all liability for the acts, omissions, or products of third parties.

If a Customer (such as your property owner or manager) has provided you with access to the Services, that Customer may collect information about your use of the Services independently of Walk In, and that collection is not controlled by Walk In. We encourage you to review the applicable Customer’s own policies.

4. License Grant and Restrictions

Subject to your compliance with these Terms, Walk In grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and Apps solely for their intended purpose in connection with the property or account for which you have been authorized.

You agree not to, and will not permit others to:

  • copy, modify, or create derivative works of the Services;
  • reverse engineer, decompile, or disassemble any part of the Services, except as permitted by law;
  • rent, lease, sell, sublicense, or otherwise transfer your access to the Services;
  • use the Services to access, tamper with, or use non-public areas of the Platform, our computer systems, or the technical delivery systems of our providers;
  • probe, scan, or test the vulnerability of any system or network, or breach or circumvent any security or authentication measures;
  • use the Services to stalk, harass, threaten, or harm another person, or to gain unauthorized access to a property, unit, or other access point; or
  • use the Services in any manner that could disable, overburden, damage, or impair the Services, or interfere with any other party’s use of the Services.

We reserve the right, in our sole discretion, to suspend or terminate access to the Services for any account we believe is being used in violation of these Terms, including use of access histories or access credentials for threatening, harassing, abusive, or fraudulent purposes.

5. Sharing Access

Certain Services allow you to grant other individuals, such as household members, guests, or trusted service providers (for example, a dog walker or cleaner), access to a unit or property. When you do so, you authorize Walk In to collect and use that individual’s name, contact information, and other information you provide, in order to issue and manage that access. If you provide us with a person’s contact information, we will notify them that these Terms and our Privacy Policy apply to their use of the Services. If you instead provide a person with physical access (such as a fob) without giving us their contact information, you are responsible for informing them of these Terms and obtaining any consents required for you to share their information with Walk In.

6. Communications, Including SMS and Text Messages

By providing your mobile phone number and using the Services, you agree that Walk In and its service providers may contact you by email, telephone, and SMS or other text message at the number you provide, including to:

  • send account-related and transactional messages, such as access codes, security alerts, appointment or tour reminders, and support and administrative messages; and
  • with your separate consent where required by law, send you promotional or marketing messages about products, services, offers, or events.

Message frequency varies. Message and data rates may apply. Consent to receive promotional text messages is not a condition of using the Services. You may opt out of promotional SMS messages at any time by replying “STOP” to any such message, or by contacting us at support@walkiniq.com; reply “HELP” for assistance. You may continue to receive non-promotional transactional and account-related messages, including those relating to your access and security, even after opting out of promotional messages. Carriers are not liable for delayed or undelivered messages. You are responsible for any charges from your mobile carrier associated with receiving text messages.

Correspondence you send through the Apps to Walk In, to building staff, or to property management – including calls, text messages, and chat messages – may be recorded or monitored for quality assurance, customer service, and security purposes, and may be made available to property management as described in our Privacy Policy.

7. Fees and Payment

Fees for the Services are generally paid by the Customer (such as a property owner or manager) on a per-unit, per-month basis, billed annually, and may vary depending on which features the Customer has selected. If you are an individual user (such as a resident or visitor) granted access by a Customer, you typically will not be charged directly by Walk In for standard use of the Services, unless otherwise disclosed to you at the time of a specific transaction. All fees, where applicable, are described in the applicable order form, quote, or in-product disclosure and are non-refundable except as required by law or as we otherwise agree in writing.

8. Intellectual Property

The Services, including all software, text, graphics, logos, and other content made available by Walk In (excluding content you or a Customer submit), are owned by Walk In or our licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 4, nothing in these Terms grants you any right, title, or interest in the Services or our trademarks, including “Walk In,” “Walk In IQ,” “ConnectIQ,” and “SelfTourIQ.”

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WALK IN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DOOR HARDWARE, LOCK, OR OTHER THIRD-PARTY DEVICE INTEGRATED WITH THE SERVICES WILL FUNCTION WITHOUT FAILURE. YOU ACKNOWLEDGE THAT ACCESS CONTROL AND KEYLESS ENTRY SYSTEMS DEPEND IN PART ON THIRD-PARTY HARDWARE, NETWORK CONNECTIVITY, AND BLUETOOTH FUNCTIONALITY THAT ARE NOT WITHIN WALK IN’S CONTROL.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WALK IN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WALK IN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WALK IN’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU OR THE APPLICABLE CUSTOMER PAID TO WALK IN FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Walk In and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another person or entity.

12. Term, Suspension, and Termination

These Terms remain in effect for as long as you use the Services. We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice, including if we believe you have violated these Terms. You may stop using the Services and delete your account at any time by contacting support@walkiniq.com. Sections of these Terms that by their nature should survive termination – including Sections 8 through 11 and 14 – will survive.

13. Changes to the Services and to These Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may also revise these Terms from time to time. If we make material changes, we will notify you by updating the “Last Updated” date above and, where appropriate, by posting a notice on the Platform, within an App, or by email. Your continued use of the Services after a revised version of these Terms becomes effective constitutes your acceptance of the changes.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in New York, and you consent to personal jurisdiction in those courts, except as otherwise required by applicable law.

15. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Walk In regarding the Services.
